How to Apply
EB-1A: Extraordinary Ability
- Review the instructions for Form I-140, Petition for a Nonimmigrant Worker
- Complete and sign Form I-140
- Pay the filing fee (if applicable)
- Provide all required evidence and supporting documentation needed

EB-1B: Outstanding Professors and Researchers
- The employer must file a Form I-140, Petition for Alien Worker
- The employer must be able to demonstrate a continuing ability to pay the offered wage as of the priority date. Your employer may use an annual report, federal income tax return, or audited financial statement to demonstrate a continuing ability to pay your wage
EB-1C: Multinational Manager or Executive
- The employer must file a Form I-140, Petition for Alien Worker
- The employer must be able to demonstrate a continuing ability to pay the offered wage as of the priority date. Your employer may use an annual report, federal income tax return, or audited financial statement to demonstrate a continuing ability to pay your wage
EB-1A: Extraordinary Skills
To apply under the EB-1A visa category, you must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics. Your achievements must be recognized in your field through extensive documentation but you do not need to have an offer! However, you must provide evidence showing you are coming to the United States to continue work in this area of expertise. The USCIS will review all the evidence you submit which will then determine your approval results.
EB-1B: Outstanding Professors and Researchers
For the EB-1B category, you must demonstrate international recognition for your outstanding achievements in a particular academic field with at least three years of experience in teaching or researching in that academic area. Unlike the EB-1A, one must have a job offer from a university, institution of higher learning, or department, division, or institute of a private employer.
EB-1C: Multinational Manager or Executive
The last EB-1 visa category is the EB-1C for multinational managers or executives. You must have experience working in a managerial or executive capacity for a firm or corporation outside the United States for at least one year during the three years before submitting your petition. Additionally, you must seek to enter the United States to continue service for that firm or organization. Your employment must have been with the same employer, an affiliate, or a subsidiary of the employer. Your employer needs to:
- Be a US employer
- Have been doing business for at least one year as an affiliate, a subsidiary, or as the same corporation or other legal entity that employed you abroad

EB-1A Criteria: Extraordinary Skills
To prove you extraordinary skills for the EB-1A visa, you must meet three of these qualifying requirements:
Documentation of the individual’s receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavors
Documentation of the individual’s membership in associations in the field for which classification is sought, which require outstanding achievements of their members, as judged by recognized national or international experts in their disciplines or fields
Published material about the person in professional or major trade publications or other major media, relating to his or her work in the field for which classification is sought
Evidence of the person’s participation, either individually or on a panel, as a judge of the work of others in the same or an allied field of specialization for which classification is sought
Evidence of the person’s original scientific, scholarly, artistic, athletic, or business‑related contributions of major significance in the field
Evidence of the individual’s authorship of scholarly articles in the field, in professional or major trade publications or other major media
Evidence of the display of the person’s work in the field at artistic exhibitions or showcases
Evidence that he or she has performed in a leading or critical role for organizations or establishments that have a distinguished reputation
Evidence that the person has commanded a high salary or other significantly high remuneration for services, in relation to others in the field
Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.
EB-1B Criteria: Outstanding Professors and Researchers
To support your EB-1B green card application, you must meet three of these qualifying requirements:
- Evidence that the professor or researcher is recognized internationally as outstanding in the academic field specified in the petition. Such evidence shall consist of at least two of the following:
- Documentation of the individual’s receipt of major prizes or awards for outstanding achievement in the academic field
- Documentation of the person’s membership in associations in the academic field that require outstanding achievements of their members
- Published material in professional publications written by others about the person’s work in the academic field. Such material shall include the title, date, and author of the material, and any necessary translation
- Evidence of the individual’s participation, either individually or on a panel, as the judge of the work of others in the same or an allied academic field
- Evidence of the person’s original scientific or scholarly research contributions to the academic field
- Evidence of the individual’s authorship of scholarly books or articles (in scholarly journals with international circulation) in the academic field
2. Evidence that the person has at least three years of experience in teaching and/or research in the academic field. Experience in teaching or research while working on an advanced degree will only be acceptable if the individual has acquired the degree, and if the teaching duties were such that he or she had full responsibility for the class taught or if the research conducted toward the degree has been recognized in the academic field as outstanding. Evidence of teaching and/or research experience shall be in the form of letter(s) from former or current employer(s) and shall include the name, address, and title of the writer, and a specific description of the duties performed by the person.
EB-1C Criteria: Multinational Manager or Executive
Employer must be a US employer and intend to employ you in a managerial or executive capacity. The petitioner must have been doing business in the US for at least 1 year, as a legal entity with a qualifying relationship to the entity that employed you abroad in a managerial or executive capacity. No labor certification is required!
