The I 192 Waiver, Application for Advance Permission to Enter as Non-immigrant

Who is the I 192 Waiver For?

The I 192 waiver is for inadmissible non-immigrant aliens who need to apply for advance permission to enter the U.S. on a temporary basis. A non-immigrant alien is someone who is not a U.S. citizen and enters the U.S. for a limited time period for a specific reason. A non-immigrant alien may be considered inadmissible for various reasons, including health, financial, criminal, and security considerations.

What Does the I 192 Waiver Provide?

The I 192 waiver allows inadmissible non-immigrant aliens to temporarily enter the U.S, even if they have been otherwise denied.

Who is Eligible for the I 192 Waiver?

In order for non-immigrant aliens who have been denied entry to the U.S. to apply for temporary entry into the country, they must meet one of the following qualifications:

  • The non-immigrant alien possesses the necessary documents, or
  • They are an applicant for T non-immigrant status, or
  • They are an applicant for U non-immigrant status.

This waiver may be inappropriate for some non-immigrant aliens, such as those inadmissible under INA section 212(a)(3)(A)(i)(I), (A)(ii), (A)(iii), (C), (E)(i), or (E)(ii) or only under INA section 212(a)(3)(D).

The I 192 Waiver Process

The I 192 waiver is for inadmissible non-immigrant aliens who need to apply for advance permission to enter the U.S. on a temporary basis. A non-immigrant alien is someone who is not a U.S. citizen and enters the U.S. for a limited time period for a specific reason. A non-immigrant alien may be considered inadmissible for various reasons, including health, financial, criminal, and security considerations.

The I 192 Waiver Processing Times

Form I-192 waiver application processing times vary from case to case.  While the ARO goal is to complete the adjudication of each application within 4-6 months of the filing date, there are many cases in which the processing period is much longer.  In many cases, the delay is not at the ARO, but with another federal agency responding to the necessary background and security checks.  The good news is that the first waiver application usually involves the longest processing time.  Subsequent Form I-192 waiver applications are usually processed much quicker – generally within 3-4 months. 

I 192 Waiver Renewal Application

By regulation, nonimmigrant waivers may only be issued for a maximum period of 5 years at a time. Some Canadians find this confusing, as the U.S. used to offer “lifetime waivers” – also known as Canadian Border Crossing Cards.  The U.S. did away with CBCCs and no longer issues lifetime waivers, however, those that were issued prior to the change in U.S. law remain valid so long as no new grounds of inadmissibility have arisen since the issuance of the CBCC.  

First time waiver applicants are not likely to receive a validity period of 5 years.  The first nonimmigrant waiver issued will usually be for a period of one year.  Some first time waivers are only issued for six months.  Others are issued for 2-3 year periods.  On average though, most first time applicants receive a waiver for a period of one year.

This meaning you will have to apply for a renewal application when your time is up.
