Background
A US company, Brickwall Packaging, retained with Niren & Associates for a TN application for the beneficiary, Matthew Martin, as a Scientific Technician.
Immigration Situation
The TN application was denied at the port of entry on July 2016. We suggested that our clients reapply through the USCIS service center. However, they chose to go through premium processing which had an added filing fee of $1225, as well as an extra $325 filing fee for an I-129 form. The $1225 fee was to certify that a decision would be made within 15 calendar days.
The reapplication was received by USCIS on September 28, 2016. On October 7, 2016 our office received a receipt that requested a signed G-28 from the petitioner (a form normally required for the beneficiary). Even though the application was under the Scientific Technician category, on October 22, 2016 we received a Request for Evidence that asked for additional evidence for Mr. Martin’s Management Consultant TN. After the lawyer personally spoke with a supervisor at the service center, we received the correct application of the Request for Evidence on October 25, 2016. On January 19, 2017, we received a five-page denial notice from USCIS that had no proper documentation to support their final decision.
Solution
The lawyer contacted the supervisor and pointed out the mistakes made by USCIS. After the supervising Officer had a chance to review the entire matter, an approval notice was received on February 17, 2017 – nearly five months after the application was received, a lot longer than the 15 calendar days that the $1225 filing fee originally guaranteed.
Outcome
The clients were so happy and relieved that they retained with us again in May 2017 for another TN.
