Recently, we’ve seen many different variations of travel restrictions to decrease the spread of COVID-19 in Canada. Along with temporary flight bans, individuals traveling through air must take a COVID-19 test upon arrival and stay in a hotel for three nights until their COVID-19 test is negative. The problem is, many individuals are finding loopholes to avoid these travel restrictions, and it’s not helping those provinces that are still struggling with COVID-19. Here is what we’ve gathered and what you should expect as an international student traveling to Ontario!

Plans to Restrict International Students Traveling to Ontario

Premier Ford of Ontario wrote in a letter,

“In the past two weeks, over 150,000 people – not including essential commercial truckers – have crossed Canada’s land borders. This includes dozens of individuals who crossed between April 24, and April 26, 2021, after traveling from countries where direct flights to Canada are currently banned. This is not just an Ontario problem – it is a Canada-wide problem.”

As of right now, many international students are still traveling to Canada as they are currently exempt from travel restrictions by showing a valid study permit or a letter of introduction that shows they were approved for a permit. Authorities are working on stronger restrictions that decrease the number of international students crossing the Canadian border.

Last week on April 29th, Canadian Prime Minister Trudeau announced tentative plans to suspend the entry of students to Ontario. This started with a request from Premier Ford to stop allowing students to come to Ontario as COVID-19 cases start to increase. Trudeau has not added any information yet about when it will start and end but we are confident we will be seeing updates shortly!

Coronavirus Cases in Ontario

As of April 30th, there were 3,887 new cases reported in Ontario which surpasses the total of cases in other provinces. Ontario’s hospitals admitted an all-time high number of patients in mid-April as almost 2,400 people were hospitalized at the peak. The good news is, Ontario officials are forecasting everyone over the age of 18 years old will be able to book a COVID-19 vaccine by May 24.

Just two weeks ago, a temporary flight ban from India and Pakistan was implemented as 36 cases of the B.1.617 Coronavirus variant were reported. Of the 36 cases identified, six were linked to international travel and were detected through PHO’s genomic surveillance program. The other 30 were detected through Ontario’s airport and land border screening programs.

Express Entry favors young students who have had work experience in Canada.

The Migrant Workers Alliance for Change has called on provincial and federal governments to make the Post-Graduate work permits renewable. “We call on the federal government to make immediate changes that support students during the new global reality we are in,” the petition reads. The petition also states that families of international students should be allowed to obtain work permits, tuition fees should be lowered, and all migrants should be granted PR status.

President Trump and Concern About Changing Immigration Laws

Recently, the U.S Citizenship and Immigration Services (USCIS) announced a policy change that would go into effect on August 9th, 2018. This policy deals with the unlawful presence of students on American soil. According to Immigration, Refugee, and Citizenship Canada (IRCC), “international education represents a significant economic benefit to Canada with international students contributing $21.6 billion to Canada’s GDP and supporting nearly 170,000 jobs in 2018. International students are also excellent candidates to apply to remain in Canada permanently, with nearly 54, 000 former students becoming permanent residents in Canada in 2018”.

Nevertheless, COVID-19 has impacted the lives of many international students who intended on traveling to Canada to begin their education programs and thereafter wanted to obtain a post-graduation work permit in order to gain Canadian work experience. Accordingly, Canada has recognized the current limitations surrounding travel and has advised of flexibility for students who are unable to be physically present in Canada in order to commence their studies.

Specifically, IRCC released a notice regarding the Flexibility in post-graduation work permit rules to help international students and Canadian post-secondary institutions. With this, IRCC announced a major update and reform to its PGWP rules for international students who intend on beginning their studies this fall.

What is PGWP?

The PGWP allows international students who have obtained a Canadian education at a designated learning institution (DLI) to gain Canadian work experience.

In order to be eligible for PWGP, the international student must have completed a full-time program at a DLI for at least eight months and this program must have granted them a diploma, degree or certificate.

A PGWP is a pathway for international students to work in Canada upon graduation from the DLI for up to three years. The length of a PGWP is dependent on the length of the program of study in Canada. It allows students to have exposure to great opportunities by working in Canada post-graduation. This further enables international students to have a great advantage in their future applications for permanent residency should they choose to make Canada their permanent home.

These candidates possess important and vital human capital characteristics which support the labour market in Canada. As such, these are ideal candidates for permanent residency as they assist the Canadian economy both in the present and will continue to in the future.

Overall, the most popular stream for former international students who obtained Canadian work experience by way of a PGWP is the Express Entry Canadian Experience Class stream, which awards additional points under the Comprehensive Ranking System for their previous Canadian education and work experience.

The most recent draws for Express Entry have been candidates who are eligible for the Canadian Experience Class stream. As such, an increasing number of former international students who obtained Canadian work experience have been invited to apply for permanent residency under this program.

What is the IRCC’s update on the PGWP?

Generally, online courses undertaken by international students during the course of their study are not eligible for a PGWP. As such, under normal circumstances, an international student’s ability to pursue distance learning is limited if they wish to be eligble for a PGWP after compelting their program of study at the DLI.

However, in response to the international travel restrictions amidst the COVID-19 pandemic, many DLIs are offering their courses online and are resorting to distance learning. As such, many international students will be beginning their programs through distance learning at a Canadian DLI and will not be physically present in Canada because of their current inability to travel.

IRCC has acknowledged that PGWP eligibility will not be affected for international students who will be commencing their studies in Canada in fall 2020 through online courses at a Canadian DLI. International students are now able to complete up to 50% of their program through online courses if they are unable to travel to Canada sooner. In order to further assist international students in this situation, no time will be deducted from the length of a PGWP for studies which were completed outside of Canada, up to December 31, 2020.

What Does This Mean for the Future of Canadian International Students?

IRCC’s announcement solidifies Canada as an extremely attractive destination for international students who wish to pursue their education endeavors and gain work. It is also appealing for those who eventually want to make Canada their permanent home.

Canada’s emphasis on encouraging international students to pursue their studies via distance learning will attract more as they still have the ability to obtain a PGWP, as if they were physically studying in Canada.

The eventual avenue and transition to permanent residency makes Canada the top choice for international students and has proven to be the most appealing destination accordingly.

Students Who Need a CAQ

To get your CAQ, you will need to meet certain conditions. Studying has to be your main activity and you need to maintain a valid hospitalization and health insurance for you and your family members who are accompanying you. If you do not follow these requirements, it could jeopardize whether you receive your CAQ and could hinder you from completing your studies.

Most individuals who intend to study in Quebec must first obtain a CAQ before applying to the Canadian federal immigration authorities for a Canada Study Permit. In order to apply for a CAQ for a study program, the applicant must first obtain a letter of acceptance from a Designated Learning Institution. Certain individuals may be excused from the requirement for a CAQ before applying for a study permit. Otherwise, if an individual is excused from the requirement for a study permit, he or she may also be exempt from the requirement for this certificate.

Individuals who are intending to pursue a study program of six months or less do not need a CAQ or a study permit. However, it is important to verify if a Temporary Resident Visa (TRV) is required, in order to be able to enter Canada as a visitor.

Temporary Foreign Workers Who Need a CAQ

A Quebec-based employer hiring a foreign skilled worker on a Temporary Work Permit must secure a CAQ as well as a Labour Market Impact Assessment (LMIA).

The CAQ certifies that the Quebec Ministère d’Immigration, Diversité et Inclusion (MIDI) concurs with Service Canada’s assessment that hiring a foreign worker will have a neutral or positive effect on the local labour market.

Temporary Workers Exempt from the CAQ

Some foreign nationals who wish to work temporarily in Québec are not required to obtain a Certification d’acceptation du Québec (CAQ – Québec Acceptance Certificate) for temporary work:

• jobs in Quebec that will last for a period of 30 days or less
• if the job is not remunerated
• if the employer is exempt from the obligation to apply for a Labour Market Impact Assessment, issued jointly by the governments of Canada and Québec
• if they are exempt from the obligation to hold a work permit issued by Citizenship and Immigration Canada (CIC).

Keep in mind, just because foreign worker has not obtained a CAQ does not exempt the employer from applying for a Labour Market Impact Assessment from the Government of Canada.

CAQ Processing Time

Average application processing time is three to four weeks when the application is complete (i.e. once the MIFI has received your online application AND your accompanying paper documentation, and provided no documents are missing). Note that the timeframe is the same whether you drop off your application in person or mail it. Presence in Canada does not provide preferential treatment. Mailing times must also be factored into the processing period.

Make sure you send a complete application and error-free information right from the start. Note that you cannot send documents in separate packages; if documents or information is missing, you will receive a refusal letter, and will then need to send the missing documents. The above scenario will result in increased processing delays.

With the coronavirus outbreak and classes being canceled, Canada changed that there is no maximum hours for those students working in an essential service.
