How can you do it if you’ve already only worked for yourself?

If you want to immigrate to Canada as a skilled worker through one of the Express Entry programs but have self-employed experience or have run a business without forming a formal corporation in the past, you must provide evidence of your entrepreneurial activities.

For investors and businesspeople applying for permanent residence under business immigration programs, there are different requirements. For those who want to immigrate under the Self-Employed Persons Program, there are additional requirements.

Regarding the documents confirming entrepreneurial activity, the official Canadian site states the following:

“If the applicant is self-employed, articles of incorporation or other evidence of business ownership, evidence of self-employment income and documentation from third-party individuals indicating the service provided along with payment details (self-declared main duties or affidavits are not acceptable proof of self-employed work experience)”.

If the applicant is self-employed, he must present:

Articles of incorporation or other proof of ownership of a business

  • Registration certificate for a business or self-employed person 
  • License, if required for the type of your business activity  
  • a screenshot of a business website with a link
  • Photos of the place of employment (for instance, if you own a shop or a stand in the construction materials market, take a photo of it and attach it to the application; this will make it simpler for an immigration officer to understand what you do there)

Evidence of self-employment income:

  • Agreements and contracts with customers or suppliers
  • Work completion certificates
  • Pension fund certificates containing the amounts of contributions
  • Tax reports
  • Bank statements

Reference Letters

Reference letters from third parties, such as clients or suppliers, that list the services rendered and include payment details. In order for the immigration officer to get in touch with the client or supplier and confirm the legitimacy of the document, their contact information must be included in the letter.

Notarized Translation

All translations produced by a certified translator into English or French and notarized, as well as:

  • Affidavit of the translator
  • Copies of the original documentation

The more documents, the better. However, letters that the self-employed individual wrote themselves outlining their job responsibilities will not be accepted.

To ensure that the immigration officer has no doubts that you are an entrepreneur and that this is your primary occupation, you must attach all necessary documentation.

You may be wondering what you should be doing during this waiting period. While you wait in the pool, get ready to accept an invitation to apply. If Canada invites you to apply, you’ll have 60 days to submit a complete application. There are several actions you can take to get ready while waiting for that invite.

Getting Documents for ITA Ready

Having all of the needed documents ready will make the application process easier within the next 60 days. These documents include:

Language Tests

Verify that your language test results are valid.   They must still be in effect when you submit your application for permanent residency.

If your results expire before then, you will want to:

  • repeat the test or
  • apply before your test results expire (if feasible) or
  • Refuse the invitation and enter the pool again to be considered in a later draw

Your application for permanent residency will be denied if your language test results are no longer valid.

Police Certificates

You and any family members who are at least 18 years old must obtain police certifications.

Obtaining a police certificate can be a lengthy process in some countries. Ask for them now that you’re in the pool, so you can submit them before your 60 days are up.

Find a Job with Job Match

By creating a Job Match account with Job Bank, you can continue your job search. A database called Job Bank will assist you in connecting with employers looking for workers with your set of talents.

You will need the Job Seeker validation code that you obtained when submitting the profile to complete this. Once you’ve entered Canada, you may always use Job Bank to look for a job.

Try to Improve Your CRS Score

You can raise your ranking in the pool and raise your likelihood of receiving an application invitation by:

  • using Job Bank to obtain a legitimate job offer
  • using private sector job boards to market your skills to Canadian businesses and contacting the provinces and territories to ask them to consider you for the Provincial Nominee Program
  • improving your language score
  • improving your education
  • gaining more relevant work experience

Keep Your Express Entry Profile Up-to-Date

It is your responsibility to maintain the truth and accuracy of the information in your profile at all times. You must update your profile if  something changes regarding your situation, such as:

The Ontario French-Speaking Skilled Worker Stream is one of eight immigration streams to give qualifying candidates the opportunity to gain Canada PR through Ontario’s Provincial Nominee Program (OINP).

French-Speaking Skilled Worker Stream Requirements

Work Experience

Once you’ve decided if you will be applying through the Canadian Experience Class (CEC) or Federal Skilled Worker Program (FSWP), you must meet the respective work experience requirements for that program.

Education

You must have a Canadian bachelor’s, master’s, or PhD degree or its equivalent in another country.

Language

You must be able to understand, read, write and speak French at a Canadian Language Benchmark (CLB) level 7 or higher. You must also be able to understand, read, write and speak English at CLB level 6 or higher. To prove that you have the mandatory language skills, you must take an approved French and English language test before you submit your application to this stream.

Settlement Funds

You must have enough money to support yourself and any dependents settling with you in Canada. You can meet this requirement through one or a combination of any of the following:

  • funds as demonstrated by the balance listed in bank statements, or statements of accounts showing other investments such as non-locked in, fixed-term deposits, mutual funds, etc.
  • annual earnings from ongoing employment in Ontario
  • a job offer in Ontario

Intention to Live in Ontario

You must intend to live in Ontario after you’re granted Canada PR. Ontario woll determine this by examining your ties to Ontario, which can include things like:

  • working or have worked in Ontario
  • getting job offers or applying/interviewing for jobs
  • studying
  • volunteering
  • leasing or owning property
  • visiting
  • having professional networks and affiliations, family ties, and personal relationships

Legal Status in Canada (if applicable)

If you are applying from within Canada, you must have legal status (a visitor record, study permit, or work permit) at the time you apply and should maintain that status until the time of nomination.

Federal Skilled Worker Program (FSWP)

If you choose to be assessed against the FSWP, you must score at least 67 points on the six selection factors (education, language skills, work experience, age, arranged employment in Canada, and adaptability).

As stated by top government sources, the announcement will be made on Tuesday, and the change will take effect on Wednesday.

According to a government statement, the mandate was deferred due to Canada’s high immunization rate and a drop in coronavirus infections. Approximately 32 million, or roughly 90 percent, of eligible Canadians have been vaccinated.

The mandate was also stopped for anybody leaving Canada. It may be reinstated later, particularly if a new strain becomes popular.

“While the suspension of vaccine mandates reflects an improved public health situation in Canada,” Health Minister Jean-Yves Duclos stated.

Despite these suspended rules, foreign visitors to Canada will still need vaccination.

This change will take effect for US-bound plane travelers at midnight on Sunday, according to authorities.

As told by a senior administration official, the CDC is eliminating the limitation that the tourism industry had pushed against for months after finding it was no longer required “based on the science and data.” The CDC can evaluate the order at any moment and perhaps restore it, especially if a new variety emerges that causes worry. Since January 20, 2021, the legislation has been in effect.

According to the source, the Biden administration intends to work with airlines to guarantee a seamless transition, although the shift will likely be welcomed by most in the business.

Airlines for America chief Nick Calio, whose group recently met with White House officials, stated that travel industry officials have been extremely critical of the requirement in recent weeks and have actively urged the Biden administration to repeal it, arguing that it is having a chilling effect on an already fragile economy.

Last month, White House officials met with travel industry representatives, who urged the Biden administration to remove the requirement that immunized overseas tourists take a Coronavirus test before traveling to the United States.

Airlines for America stated that its members, which include American Airlines, United Airlines, Southwest Airlines, and Delta Air Lines, thought that removing the criteria would encourage more international visitors to visit the United States.

According to the trade association, domestic travel was within 7 percentage points of pre-pandemic norms in mid-May, while overseas travel was 14 percent below usual.

The decision was applauded by US Travel Association President and CEO Roger Dow.

“Prior to the pandemic, travel was one of our nation’s largest industry exports. The lifting of this requirement will enable the industry to lead the way toward a broader US economic and jobs recovery,” Dow said in a statement.

As of July 4, 2022, the length of stay for Super Visa holders in Canada will be expanded to five years per entrance.

People who presently hold a Super Visa can also obtain an extension of up to two years while in Canada. This implies that existing Super Visa holders can now stay in Canada for up to seven years in a row.

In the future, Canada’s Immigration Minister will have the right to appoint foreign medical insurance providers to offer coverage to Super Visa applicants.

Super Visa holders can currently stay in Canada for up to two years each admission. The Super Visa is a multi-entry visa with a validity period of up to ten years.

Currently, only Canadian insurance carriers may provide the medical coverage required of Super Visa applicants. Immigration, Refugees, and Citizenship Canada (IRCC) has announced that more information would be released at a later date.

Kyle Seeback, a Conservative Party of Canada member, suggested these improvements in Bill C-242. The IRCC’s news statement today indicates that the ruling Liberal Party of Canada supports the revisions and will vote in favor of Bill C-242, which is presently being debated in Parliament.

According to IRCC, roughly 17,000 Super Visas are issued in Canada each year.

Who Is Eligible for the Super Visa?

The Super Visa has been available as an option to the Parents and Grandparents Program for over a decade (PGP). The PGP provides permanent residence, but since it is so popular, the demand to sponsor significantly outnumbers the number of available slots. IRCC receives interest from over 200,000 sponsors each year but only allocates approximately 20,000 immigration places through the PGP. As a result, IRCC has temporarily opened expressions of interest for the PGP in recent years, followed by lotteries that grant invitations to apply for permanent residency under the PGP.

As a result, persons who pass a medical examination and present proof of private health insurance from an approved insurance provider are eligible for the Super Visa. This is done so that Super Visa holders can receive emergency health treatment in Canada without having to pay for it through Canadian taxpayers. Furthermore, host children or grandkids must fulfill the IRCC’s income standards.

What Is The Atlantic Immigration Program (AIP)?

The IRCC introduced the Atlantic Immigration Pilot Program (AIPP) now known as the Atlantic Immigration Program (AIP) in March 2017 to recruit newcomers to the Atlantic provinces giving a pathway to Canada PR as skilled foreign workers. While most newcomers are drawn to fast-paced cities like Toronto, Montreal, or Vancouver, the AIP is specifically targeted at the Atlantic provinces: Newfoundland and Labrador, Prince Edward Island, Nova Scotia, and New Brunswick.

Occupations That Became Ineligible

When the NOC code 2021 update is implemented, these are the occupations that will no longer be eligible:

  • Material handlers

What Is Express Entry?

Occupations That Became Eligible

With a lot of industries experiencing labor shortages country-wide, the IRCC has added 16 occupations that are now eligible through Express Entry through the NOC code update.   • Payroll administrators
  • Dental assistants and dental laboratory assistants
  • Nurse aides, orderlies, and patient service associates

  • Correctional service officers 
  • By-law enforcement and other regulatory officers 
  • Estheticians, electrologists, and related occupations

  • Transport truck drivers 
  • Bus drivers, subway operators, and other transit operators
  • Heavy equipment operators
  • Aircraft assemblers and aircraft assembly inspectors.

Occupations That Became Ineligible

On the flip side, there were three occupation categories that became ineligible with this NOC code update. Those categories include:

  • Other performers
  • Program leaders and instructors in recreation, sport, and fitness
  • Tailors, dressmakers, furriers, and milliners

The COVID-19 travel restrictions have been removed, and Toronto Pearson, Canada’s main airport, has witnessed a substantial rise in passengers. More people are coming through Pearson as Canada’s main airport than at any other point during the epidemic, and many of the government’s health screening procedures are still in place.

Arriving in Canada on an International Flight

Upon arrival, some foreign travellers encounter lengthier wait times than planned. This is due in part to protracted border processing periods. Prior to the pandemic, clearing an international arriving passenger took an average of 15-30 seconds for a Canada Border Services Agency (CBSA) officer. The processing time at Canada’s borders has increased by two to four times due to the government of Canada’s COVID-19 health screening questions.

As a result, passengers may need to be kept on their aircraft or in designated waiting rooms within the terminals during the late afternoon or nighttime peak hours, when a high number of planes arrive close together.

Once they have obtained citizenship, they can come to the United States using the TN visa provided they have a legitimate employment offer from a US company in one of the approved occupations. The TN visa is valid for three years and can be extended. There is no restriction on how many times it may be renewed.

The procedure is quite simple. While the TN visa is valid, applicants may bring their spouse and children (under 21) to the United States. Dependent family members are eligible to apply for a TD visa. If the application is granted, the dependents will obtain an I-94 record identifying their length of stay in the United States, which is normally the same as the TN visa holder.

TD visa holders are not permitted to work in the United States, but they are permitted to study at US universities without the need for a student visa. The duration of stay can be extended if the dependents have a valid passport that extends beyond the duration of their stay, have not broken the terms of their stay in the United States, and have not committed a felony. The procedure of requesting an extension should begin at least 45 days before the I-94 record expires.

Can I Apply for a Green Card While Being on a TN Visa?

The TN visa does not permit dual entry. That implies you should not apply for a green card while you are on this visa. You can, however, apply for a US green card by changing your visa category to a non-immigrant category such as H-1 or L-1. They are visa categories with dual intent.

One might enter the country on the TN visa and then ask the company to sponsor them on the H-1 or L-1 visa.
